Welcome to NovelMaker. These Terms and Conditions (“Terms”) describe the rights and responsibilities that apply to your use of the NovelMaker application (the “App”). By using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use NovelMaker.
NovelMaker is only available to you if you have reached the age of majority in your jurisdiction of residence and are fully able and competent to enter into, abide by, and comply with these Terms.
1. Acceptance of Terms
By accessing or using NovelMaker, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
2. Privacy Policy
Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and share information. By using the App, you agree to the terms outlined in the Privacy Policy.
3. Cookies
NovelMaker may use cookies and similar technologies, including tracking cookies and session cookies, to improve the App’s functionality, analyze usage, and enhance user experience. By using the App, you consent to our use of cookies as described in the Privacy Policy.
4. User Account Responsibility
If you create an account on NovelMaker, you are responsible for maintaining the security of your account, including your login credentials and any content you submit. You represent that you have the right to use all content you provide, including descriptions, prompts, and story ideas.
You must immediately notify NovelMaker of any unauthorized use of your account or other security breaches. NovelMaker is not liable for any acts or omissions by you, including damages of any kind incurred as a result of such acts or omissions.
NovelMaker may, in its sole discretion, change or remove any content that it considers inappropriate, unlawful, or otherwise likely to cause liability.
5. Third-Party Services
NovelMaker integrates with third-party services to provide certain features, including:

Image Generation: Provided by external partners (e.g., MidJourney), subject to their respective terms of service.

Language Models: NovelMaker uses third-party large language models (LLMs) to create or enhance content. Prompts, descriptions, and potentially sensitive information may be shared with those providers.
By using the App, you acknowledge and agree to the terms of these third-party providers. NovelMaker is not responsible for the handling of your data by such providers.
6. Fees and In-App Purchases
You agree to pay all applicable fees for your use of NovelMaker in accordance with the billing terms set forth within the App and on your invoice. We reserve the right to update prices at any time, with changes becoming effective at the start of your next billing cycle.
We may verify your payment method, charge your card for amounts due, and automatically update your card information when expired or invalid. You agree that your payment and personal data may be shared with third parties for payment processing and fraud prevention.
We may suspend or terminate your use of the App if your payment information is inaccurate or not current. You are responsible for any fees, overdraft charges, or penalties resulting from failed payments.
Sales and Promotional Offers: From time to time, we may offer discounts, free trials, or promotional pricing. These offers are subject to eligibility requirements, expiration dates, and may be modified or terminated at any time. Unless otherwise stated, promotional pricing applies only to new subscriptions and cannot be combined with other offers.
Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying. For purchases through app stores, tax collection is handled in accordance with the applicable platform’s tax policies.
Fee Disputes: You must contact us within sixty (60) days of any charge to dispute fees. Disputes submitted after this period may not be considered. Refund requests for app store purchases must be submitted directly through the applicable platform, subject to their refund policies.
7. User Generated Content and Intellectual Property
The App may contain information, text, graphics, photos, videos, or other materials (“Content”), including Content created with or submitted to the App by you (“Your Content”). We take no responsibility for, and do not expressly or implicitly endorse, any of Your Content.
By submitting Your Content, you represent and warrant that you own or have all rights necessary to use and share it. You retain ownership of Your Content, but you grant NovelMaker a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works from, distribute, perform, and display Your Content in all media formats now known or later developed. This license includes the right to make Your Content available for distribution or publication by third parties who partner with NovelMaker.
You also agree that we may remove metadata associated with Your Content and waive any claims regarding moral rights or attribution. While we are not obligated to monitor or screen Your Content, we reserve the right to remove any Content at our discretion, including where it violates these Terms, our Privacy Policy, or applicable law.
8. Child Protection and Sensitive Content
NovelMaker is designed to be safe and appropriate for users aged 4 and older. The App includes filters to help minimize exposure to harmful, sensitive, or inappropriate content; however, no filtering system can guarantee complete protection.
Parents and guardians are responsible for supervising children’s use of the App and ensuring it is used appropriately. Users must not use NovelMaker to create, share, or promote any illegal, harmful, or otherwise inappropriate material.
If you encounter any content you believe is unsuitable for children, please report it immediately through the in-app reporting tools or by contacting our support team contact@novelmaker.co
9. Child Privacy
We take children’s privacy seriously. NovelMaker does not knowingly collect, store, or share any personal data from children. For more information about how we handle user information, please review our Privacy Policy, which outlines our data collection and protection practices.
10. Limitation of Liability
NovelMaker provides the App and its AI-powered storytelling features “as is” and without warranties of any kind. To the fullest extent permitted by law, NovelMaker and its affiliates, officers, directors, employees, and licensors disclaim all liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or relating to your use of the App.
We are not liable for:

The accuracy, reliability, or safety of generated content.

Losses or damages resulting from AI-generated stories, images, voice cloning, or children’s content created through the App.
You use NovelMaker at your own risk, regardless of legal theory, and whether or not we were advised of the possibility of such damages.
11. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms, misuse the App, or create liability for NovelMaker. Upon termination, your right to use the App will immediately cease.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any disputes arising under these Terms.
13. Changes to Terms
NovelMaker may revise these Terms at any time. Changes will be effective when posted in the App or on our website. Your continued use of NovelMaker constitutes acceptance of the updated Terms.
